This Online Liability Policy applies to all students, parents, guardians, instructors, and participants using the online educational services provided by Subito Music ("Subito"). By enrolling in or participating in Subito's online lessons or programs, the student, or the student's parent or legal guardian if the student is a minor, acknowledges and agrees to the terms of this Policy.
Subito provides music education remotely through video conferencing, online platforms, websites, and other digital technologies. Because instruction occurs remotely, Subito instructors do not control or physically supervise the student's location. Students and parents are responsible for providing:
Parents and legal guardians remain responsible for the supervision and safety of minor students while they participate in online lessons. An instructor's presence through video conferencing does not replace parental or adult supervision. Parents are responsible for ensuring that the student's physical environment, instrument, equipment, internet access, and online participation are appropriate for the student's age.
Although online music instruction generally involves limited physical risk, playing an instrument or singing may involve physical activity, repetitive movements, posture, and exposure to sound. Students should immediately stop an activity if they experience pain, significant discomfort, dizziness, hearing discomfort, or other physical problems. Subito and its instructors provide music education and do not provide medical, physical therapy, occupational therapy, or other healthcare advice. Students and parents should consult an appropriate healthcare professional regarding medical or physical concerns.
Students and parents are responsible for the proper installation, maintenance, and safe use of instruments, computers, headphones, speakers, microphones, furniture, cables, and other equipment used during online lessons. Subito is not responsible for loss of or damage to a student's instrument, electronic equipment, furniture, or other personal property except where liability cannot legally be excluded.
Online lessons depend on internet connections, computers, video-conferencing platforms, payment systems, and other third-party technologies. Subito cannot guarantee uninterrupted or error-free service and is not responsible for interruptions caused by circumstances outside its reasonable control, including:
When a technology problem within Subito's reasonable control materially prevents a scheduled lesson from occurring, Subito may provide a reasonable remedy consistent with its scheduling and makeup-lesson policies.
Students and parents are responsible for protecting their account passwords, lesson links, login credentials, devices, and home networks. Lesson links and account credentials should not be shared with unauthorized people. Subito will use reasonable measures appropriate to its operations to protect student information, but no internet-based communication or information system can be guaranteed to be completely secure. Subito's collection and use of personal information are additionally governed by its Privacy Policy.
Students, parents, instructors, and other participants may not record, reproduce, distribute, livestream, or publicly share a lesson without authorization from Subito and any consent required by applicable law. Subito will obtain any consent required by applicable law before using a student's name, image, voice, likeness, or recorded performance for public advertising or promotional purposes.
Subito instructors are required to maintain professional boundaries and appropriate conduct during online lessons. Instructors may not engage in inappropriate, abusive, threatening, discriminatory, sexual, or sexually suggestive communications or conduct with students. Concerns regarding instructor behavior should be reported promptly to Subito management. Subito reserves the right to suspend or terminate an instructor or student's participation when necessary to protect students, instructors, or the integrity of the Subito Music.
Subito provides educational instruction but does not guarantee any particular level of musical progress or achievement. Subito does not guarantee:
Student results depend upon many factors, including attendance, practice, preparation, ability, and individual effort.
By participating in Subito's online programs, students and parents acknowledge and voluntarily accept the ordinary risks associated with music instruction and remote participation. Students and parents are responsible for conditions within the student's home or other physical location that are outside Subito's reasonable control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Subito Music and its owners, affiliates, managers, employees, instructors, contractors, and agents shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from participation in Subito's online services. Subito shall not be responsible for injuries, losses, or damages resulting from conditions at the student's physical location, misuse of equipment, excessive audio volume, internet, or technology failures outside Subito's reasonable control, or failure to follow reasonable safety instructions. To the maximum extent permitted by law, Subito's aggregated liability arising from a student's participation in its services shall not exceed the tuition actually paid to Subito for that student during the six months immediately preceding the event, giving rise to the claim. Nothing in this Policy excludes or limits liability that cannot legally be excluded or limited.

Unless otherwise required by applicable law, this Policy shall be governed by the laws of the State of Texas. If any provision is determined to be unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.
By enrolling in, purchasing, or participating in Subito Music's online services, the adult student or the parent/legal guardian of a minor student acknowledges that they have reviewed and agree to this Online Liability Policy. Electronic acceptance, including acceptance through Subito's enrollment or payment system, may constitute acknowledgment of this Policy to the extent permitted by applicable law.
